Have you ever wondered what the person receiving the text is doing while your testing them. Well now you better be careful. A New Jersey superior Court set a precedent recently stating that the person sending a text message has a duty not to text someone who is driving if the texter knows, or has special reason to know, the recipient will view the text while driving. You can find a copy of the opinion here: http://www.judiciary.state.nj.us/opinions/a1128-12.pdf. For a great article about it read the following: http://www.abajournal.com/news/article/remote_texter_can_be_held_liable_for_distracted_drivers_crash/?utm_source=maestro&sc_cid=130828AT&utm_campaign=weekly_email&utm_medium=email.
